The Pure Golfer Terms and Conditions
Booking Terms and Conditions (as of October 2024)
Please read these Booking Terms and Conditions carefully as they constitute the basis upon which bookings are accepted with The Pure Golfer Pty Ltd. (ABN 93 678 560 328). By booking with us, you are deemed to have agreed to these Booking Conditions (which constitutes the agreement between you and us). Your booking will only be accepted and confirmed on the basis that you have accepted these Booking Conditions on behalf of all travellers in your party. The services to be provided are those referred to in your booking confirmation and/or invoice.
- Definitions
In these Terms and Conditions the following words shall have the meanings ascribed to them:
‘Booking’ means your acceptance of a Quote via The Pure Golfer’s receipt of the relevant Deposit and your written acceptance via email.
‘You’ means the client as detailed in the Booking and all participants on the Tour.
‘Us’ or ‘we’ means The Pure Golfer Pty Ltd trading as The Pure Golfer.
‘Service’ means, as far as applicable to each Tour, any element of the Tour, including but not limited to accommodation, food, sight-seeing, recreational and sporting activity provided to you during the Tour, detailed in the Booking or added by agreement between you and us.
‘Invoice’ means the invoice addressed to you.
‘Quote’ means the information and price details relating to a particular Tour provided by us, which are based on the information provided to us by you at the date of the Quote; and
‘Tour’ means the entirety of the Services to be enjoyed by you from the date of commencement to the date of return, all as set out in the Booking.
‘Extras’ means any costs in addition to your paid balance during your time on tour with us.
- Application of these Terms and Conditions
These Terms and Conditions apply to all the Tour, Quotes, Bookings, Services provided to you during the Tour and any additional Services taken up by you during the Tour, except where specifically stated otherwise. In the event of any inconsistency or conflict between these Terms and Conditions and any alternative or additional Terms and Conditions in respect of which notice has been given to you, the provisions of these Terms and Conditions shall prevail. The Pure Golfer will not provide any refunds, exchanges or credits if a traveller breaches the Terms and Conditions.
- Booking on Behalf of a Group
If you are booking on behalf of a third party (or group), you represent and warrant that you are authorised to accept these Booking Terms on behalf of those you are booking, and that you will ensure they are legally bound by these Booking Terms.
- Quotes and Bookings
4.1 The prices stated in all Quotes and Bookings, along with any special conditions applicable to them, are based on your specified requirements. This includes the minimum number of participants (as specified in the Quote or Booking) travelling together on a Tour. We reserve the right to revise Quotes if your requirements change after the Quote has been issued.
4.2 All prices stated in Quotes and Bookings are inclusive of local Taxes, charged at the prevailing rate. We reserve the right to amend any Quotes to take account of changes to the prevailing rate of local tax.
4.3 All food prices in Quotes and Bookings exclude all beverages, both non-alcoholic and alcoholic, unless expressly stated otherwise.
4.4 Tips, gratuities and porterage costs are not included in Quotes or Bookings.
4.5 All Quotes are valid only on the date provided and thereafter are subject to fluctuation consequent upon any changes in our costs, rates of taxation and rates of exchange. We reserve the right to withdraw or amend any Quote subsequent to the date it is provided to you and prior to payment being made by you. Once payment has been received in full by us the price of a Booking is thereafter guaranteed, subject to the provisions of Clause 4.6 below.
4.6 Should there be any increase in the cost to us, caused by changes in transportation costs, including the cost of fuel, currency exchange rate fluctuations or other, we reserve the right to increase the Tour cost to cover it. In the case that the increase is greater than 10% of the total cost of the Tour, we will notify you and you have the option to cancel with a refund of any money paid to us, minus any charges we have already incurred. If you decide to cancel the Tour, you must do so within seven working days of the issue of the notification to you of the revised cost.
4.7 We will not make any increase in the total cost of the Tour attributable to you within 30 days prior to your scheduled commencement date.
4.8 We have taken all care to ensure information and prices are accurate, however, if we identify an error or omission, we will inform you before confirming your Booking. The revised information will then form part of your contract. The Pure Golfer reserves the right to make changes to and correct errors after Bookings have been confirmed.
4.9 On receipt of your payment, we will email confirmation of your Booking with The Pure Golfer. The confirmation will clearly state the balance to be paid and the date by which it is due. Please check the confirmation carefully to make sure that all your Booking details are correct. If your confirmation appears to be incorrect or incomplete please notify us immediately and we will endeavour to make the necessary changes.
- Payment Details
5.1 The Pure Golfer will provide you a Quote with the price of your Tour in your local currency via an email from our email address. Upon acceptance of the Quote, an Invoice will be sent via an email from our email address. Payment is to be in your local currency, unless otherwise agreed to, in written form, with the company owner prior to payment being made.
5.2 Payment can be made by Mastercard or Visa (note a card fee will apply of 2% for Visa or Mastercard) or by direct bank transfer into our business account. Payment details will be provided when we send you the invoice.
5.3 As noted in our Quote, the total price of the tour is not guaranteed as it may be subject to exchange rate variation until payment in full has been received. The Pure Golfer reserves the right to adjust the Tour cost should there be any changes in exchange rate and your local currency. Such changes are beyond the control of The Pure Golfer.
5.4 Unless otherwise stated in writing in the Quote, a Deposit of either 30% or 50% of the total cost of the Booking is payable upon confirmation of the Booking by us. Additional deposits required and itemised in the Quote such as green fees at specific courses may also be payable.
5.5 All Deposit payments are non-refundable and non-transferable.
5.6 The remainder of the payment is due 120 days prior to departure. If, for any reason, we do not receive your balance by the due date, we reserve the right to treat your booking as cancelled and apply the appropriate cancellation charges. A deposit holds services requested, but does not guarantee prices.
5.7 Late bookings, within 120 days of the Tour, are subject to full payment being received at the time of booking and full payment of any additional costs incurred for obtaining the required Tour.
5.8 The cost of your accommodation does not include any services that you may use or purchase whilst at the accommodation other than those specifically included in your Booking. You must pay the hotel directly for such additional services. We accept no liability for any charges you consume in relation to any extras such as food, drink, entertainment, spa treatments and transport, outside of the items listed in your Booking.
5.9 The cost of any additional Services or Extras that you incur during the Tour and we pay for, that are not detailed in the Booking, must be settled in full within 28 days following the final day of the Tour. An invoice will be sent to you outlining the extras within 5 days of the final day of your tour (receipts will be kept to support the invoice). In the event that you cancel your restaurant reservation within 48 hours of the scheduled reservation time, you will be liable for the full payment of the deposit paid by The Pure Golfer.
- Alteration or Cancellation
6.1 We will notify you of any necessary alterations to the Tour or if we require to cancel the Tour as soon as is reasonably possible. In the case of a minor alteration to the Tour, we will provide a comparable alternative. In the event of a major alteration to the Tour (such as a change to your golfing destination), you shall be entitled to either accept the alternative package, or to cancel the Tour with a full refund, minus any third-party charges that are non-refundable and a 10% admin fee of the total price of the Tour.
6.2 If you cancel the Tour (no fault by us), the following cancellation charges will be payable:
6.2.1 for cancellations up until 61 days prior to the commencement of the tour, all cancellation charges charged to us by our suppliers in respect of the cancelled tour plus an administrative fee of 10% of the cost of the Booking will be payable by you to us;
6.2.2 for cancellations between 60 and 31 days (inclusive) prior to the commencement of the tour, all cancellation charges charged to us by our suppliers in respect of the cancelled tour plus an administrative fee of 15% of the cost of the Booking will be payable by you to us;
6.2.3 the full price of the tour as stated in the Booking will be payable by you to us if you notify us between 30 and 0 days (inclusive) prior to the commencement of the tour that you do not intend to take up the booking; or without prior notice, you fail to take up the booking.
6.3 Once the Tour has commenced, no refunds will be issued should there be a case of illness, early return, or otherwise.
- Individual Cancellation
7.1 If at any point up to 30 days before the start of the tour, one or more members of the group cancels, we reserve the right to adjust the cost per participant for the Tour’s preparation and organisation. If, after we present this revised cost and discuss it with you, you choose to cancel the booking, you will be liable to pay the full cancellation charges as outlined in Clause 6.2.
7.2 If at any point in the 30 days preceding the day of the commencement of the Tour, more than 40% of the original number of participants in the tour have cancelled, we, in our sole discretion, shall be entitled to cancel the entire Booking. You shall then be liable to pay the appropriate full cancellation charges in accordance with Clause 6.2.
7.3 In the event that you cancel, in full or in part, a Service arranged by us for you, you shall pay to us any cancellation charges charged to us by the relevant supplier in respect of the full or partial cancellation of the Service. In the event that you make a partial cancellation of a Service, it shall be at our sole discretion whether to provide that Service to you, depending on the number of participants remaining in respect of the Service and, on the basis of this, whether the Service can feasibly be provided to you. If we consider in our sole discretion that the Service will no longer be provided to you, you shall be liable to pay the full amount of the charges charged to us by the relevant supplier as if the Service had been cancelled in full by you.
- Failure to Pay
8.1 In the event of your failure to pay us any outstanding balance by the due date, then we reserve the right to cancel the reservation, after due notice being provided to you. In such an event, or if you cancel the reservation, any deposit shall be forfeited and a cancellation charge will become payable by you to us in accordance with Clause 6.
8.2 If we become entitled to take action under this Contract (e.g. to cancel because of non-payment) but do not immediately take that action, the fact that we have not taken the action immediately will not prevent us doing so later.
- Changes in Itinerary and Force Majeure
The Pure Golfer endeavours to perform all Tours according to the published Itinerary, but reserves the right to change or substitute where necessary for reasons outside of our control including but not limited to: acts of nature, road and or weather conditions, local holidays, strikes, war, civil disturbances, pandemic (e.g. COVID-19 or a variant of the same) advice by government authorities, breakdowns, medical or customs regulations, alternations, cancellations, delays, tender unavailability or golf course cancellations. We will substitute (at the nearest possible standard) an alternative where possible. Any changes to an itinerary that incur an additional cost will not be The Pure Golfer’s responsibility, however we will assist and support with documentation as required for a travel insurance claim (refer to section 13 for more regarding Personal Travel Insurance).
- Refunds and Wet Weather
No refund is available for cancellations after the holiday has commenced or in respect of any tours, accommodation, meals, or any other services not utilised. If the weather causes golf tournaments or golf games to be cancelled or rescheduled, The Pure Golfer will refund any monies that suppliers refund to us. However, please note that in most cases, this does not occur.
- Travel and Accommodation
11.1 The Pure Golfer is not itself a carrier, hotelier, or car hire operator. All components included in your holiday are provided by reputable carriers and hoteliers on their own conditions. It is important to note, therefore, that all bookings with The Pure Golfer are subject to the Terms and Conditions and limitations of liability imposed by the various providers involved in your travel booking, some of which limit or exclude liability in respect of death, personal injury, delay, and loss or damage to baggage.
11.2 If you have a complaint or experience any problems during your Tour, please inform the relevant supplier immediately. A written complaint whilst onsite is suggested. If you do not reach an acceptable conclusion during your Tour, please notify us in writing by letter within 14 days from the end of your Tour. Any assistance provided in resolving a complaint in relation to any supplier is provided on a goodwill basis and in our capacity as an agent.
- Personal Travel Insurance
12.1 It is a condition of your booking that you are adequately insured with a robust travel insurance policy that covers you and your group for the duration of your tour. It is important that you have sufficient insurance in place to cover you and your group against things such as, but not limited to, cancellation, baggage loss, accidents, death, health issues, travel restrictions and force majeure. Your insurance should also cover you against the outbreak of disease and the outbreak of war which may affect your travel destination country.
12.2 You should also have suitable insurance to cover you for any activities which you expect to take part in, such as golf. Some insurance companies may consider the game of golf as a dangerous sport and you should mention your participation when obtaining a quotation. You should also ensure that your golf equipment is covered in the policy.
12.3 You must have access to a copy of your certificate of insurance while travelling. The Pure Golfer will provide assistance with any insurance claim you need to make.
- Visas and Passports
All passengers must have a passport that is valid for at least six months after their return date to their home country. Passengers are solely responsible for meeting necessary passport and visa entry requirements and paying all associated costs. The Pure Golfer is not responsible, nor accepts liability, for any traveller refused entry due to carrying or presenting incorrect documentation to customs or border officials. Visas, including transit visas, are the passenger’s own responsibility.
- Baggage
Please check with the applicable airlines for full details including any excess baggage charges. Due to space available in private vehicles, we advise that you only bring one large suitcase per person, as well as your golf clubs.
- Motorised Carts
15.1 To drive a motorised cart, you agree to possess a current driver’s licence, have previous experience driving a golf cart equal to a minimum of four rounds and comply with the rules of the applicable venue, course or establishment. In the event you cause, or partially cause, an incident resulting in personal or property damage, you are responsible for the costs to repair the cart and any property damaged as well as being liable for any personal injury claims and fully indemnify The Pure Golfer for any liability, loss or damage you cause.
15.2 Some walking golf courses require medical certificates in order to secure a motorised golf cart, which we will advise you of at the time of booking. It is your responsibility to provide this information, as we cannot guarantee a motorised cart without it. If you do not inform us at the time of booking, and as a result cannot secure a motorised cart, we will not be held liable for any consequences.
- Golf Etiquette
16.1 Knowledge of golf etiquette and the rules of golf are expected by all members of your group. Some golf courses will require handicap certificates before accepting visitors, which we will try to advise you of at the time of booking.
16.2 We do not accept any responsibility in any ruling by a hotel/golf course if you or any of your group is unable to play due to inappropriate attire. Please be sure that your group is aware of appropriate golfing attire before the beginning of the Tour.
16.3 Please be aware that some golf courses may pair you up with other golfers during peak times.
- Special Requests and Medical Problems
17.1 If you have any special requests, you must advise us at the time of booking. Although we will endeavour to pass any reasonable requests on to the relevant supplier, we regret we cannot guarantee any request will be met. Confirmation that a special request has been noted or passed on to the supplier or the inclusion of the special request on your confirmation or any other documentation is not confirmation that the request will be met. Unless and until specifically confirmed, all special requests are subject to availability.
17.2 If you or any member of your party has any medical problem or disability that may require assistance, please tell us before you book or if diagnosed after you confirm your booking as soon as possible after you become aware. If the supplier in question reasonably feels unable to properly accommodate the particular needs of the person concerned, we must reserve the right to decline your booking or, if full details are not given at the time of booking, cancel when we become aware of these details.
- Liability
18.1 You shall be responsible for your baggage, range finders, golf shoes, golf clubs and personal effects before, during and after the Tour. You bring all items, including but not limited to golf equipment, at your own risk.
18.2 You shall be responsible for any damage to or destruction of any property belonging to us or to a third party, which is attributable to you.
18.3 We shall not be liable to you for any damage caused to you by our failure to perform the Contract or our improper performance of the Contract if that failure is: attributable to you; attributable to a third party unconnected with the provision of the Tour, and is unforeseeable or unavoidable; or due to unusual and unforeseeable circumstances beyond our control, the consequences of which could not have been avoided even if we had exercised all due care; or an event which we or the relevant supplier, even with all due care, could not foresee or forestall.
18.4 If you have a complaint concerning any Services we provide you must inform us in writing within 14 days from your departure date. We regret we cannot accept any liability if we are not notified as such. Our maximum liability to you if we are found to have been at fault in relation to any Service we provide is limited to the total cost of the Booking of which the Service forms part. Any legal costs will be covered at your expense.
- Applicable Laws
The laws of New South Wales, Australia govern these Booking Conditions to the fullest extent allowable. Any disputes in connection with a trip or these Booking Conditions must be initiated in the courts of New South Wales, Australia.
